Commission on Judicial Conduct recommends Dickinson Judge be removed over innapropiate behavior - WBNG

DICKINSON (WBNG) -- The New York State Commission on Judicial Conduct is recommending a Town of Dickinson Justice be removed from office following numerous complaints.

The Commission of Judicial Conduct alleged that Justice Randy A. Hall sexually harassed his co-judge and court staff, asserted his office with police officers during a dispute, conveyed the impression that he had prejudged the guilt of criminal defendants and posted sexual content to his public Facebook page.

In a statement, the Commission wrote:

[Judge Hall] violated the Rules when he made inappropriate sexually charged comments to his co-judge and court staff; while on the record, he publicly inquired about employment with the police department which suggested bias in favor of law enforcement; he invoked his judicial office in connection with a personal matter and made comments which gave at least the impression that he had prejudged the guilt of three criminal defendants appearing before him. He also detracted from the dignity of judicial office when he made sexual comments on his public Facebook page, some of which referenced his judicial position.

The Commission also noted that Hall was served a formal written complaint in March 2023 about charges that were made against him stemming from the alleged incidents. The Commission said Hall did not file an answer to the charges. It also said that Hall failed to submit a response after a motion filed by the Commission Administrator sought to determine if the allegations were true.

On Thursday, the Commission sent its determination to the Court of Appeals. Now, Hall may either accept the Commission’s determination or, within 30 days from receipt, make a written request to the Chief Judge of the Court of Appeals for a review of the determination by the Court of Appeals. If Hall does not request a review, the Court of Appeals may remove him by the determination.

If a Commission determination is reviewed by the Court of Appeals, the court may accept the determined sanction, impose a different sanction including admonition, censure or removal, or impose no sanction.
