The conviction and sentence of a Rosepine man found guilty of indecent behavior with a juvenile was upheld recently by the Louisiana Third Circuit Court of Appeals.
Marvin L. Bunyard of Rosepine was convicted in November 2020 after pleading guilty to the indecent behavior charges that involved a male child under the age of 13.
Bunyard was arrested in 2019 after deputies with the Vernon Parish Sheriff’s Office received a complaint that Bunyard had engaged in indecent sexual behavior with a minor child. During that investigation, authorities said the victim indicated to them the abuse had take place numerous times while he was between the ages of 8 to 14.
According to court documents, Bunyard entered the guilty plea in exchange for a sentencing not to exceed 20 years, and for the court to drop additional sexual battery charges filed against him.
On Feb. 23, 2021 Bunyard was sentenced to 20 years at hard labor, with the first 10 years to be served without benefit of probation, parole or suspension of sentence.
In March, Bunyard’s legal counsel filed a motion to reconsider his sentencing, which was denied by the trial court. Bunyard then filed an appeal to the appellate court.
In October, the court reviewed the case and affirmed both the conviction and sentence.
“In sum, this court has performed a thorough review of the record, including the bill of information, minute entries, pleadings, and transcripts. And our review has revealed no issues that would support any assignment of error on appeal,” the court’s opinion reads.
District Attorney Terry Lambright told the Beauregard News that his office was pleased with the court’s decision.
“The state is very pleased and our office is pleased with the result out of the appeal, and we believe that justice was served regarding this matter,” Lambright said.
