A concrete manufacturing worker in Nebraska’s own behavior, including a letter she delivered to her foremen that contained “extremely offensive language,” undercut her sex discrimination, sexual harassment, and retaliation claims, the Eighth Circuit ruled Wednesday.
Amanda Gibson said the letter was meant to raise complaints regarding sex discrimination she experienced while working for Concrete Equipment Co. and race discrimination directed at a co-worker. It stated that the foremen should give more consideration to her perspective and the views of her black colleague because they were two of the few employees in their protected classes, the court said.
